Terms of Service (ToS)

By completing the registration process and using the Snapinify Cargo Optimizer software (hereinafter: "Service" or "Software"), you (hereinafter: "User") declare that you have read, understood, and agree to be bound by these Terms of Service.

1. Subject and Operation of the Service

Snapinify Cargo Optimizer is a cloud-based Software as a Service (SaaS) solution designed to support logistics companies, freight forwarders, and drivers. Its features include 3D cargo space optimization visualization, estimated freight calculation, and the generation of PDF-based waybills and documents.

Credit System: The Service requires registration. Alongside basic features, certain operations (e.g., generating and downloading PDF documents) require the use of pre-purchased virtual credits. The purchase price of credits is non-refundable and is processed by a third-party Payment Gateway. The Service Provider does not store any credit/debit card information.

2. Limitation of Liability and Logistics Risks (Important!)

The results provided by the software are strictly mathematical and geometric guidelines. The actual physical environment (e.g., shifting of cargo, vehicle suspension, road conditions) may differ significantly from the software model.

The Service Provider expressly disclaims liability for the following:

Overloading and Axle Weight: The density-based weight estimates and layouts calculated by the Software do not replace certified weighing. The freight forwarder and the driver bear exclusive responsibility for the physical overloading of vehicles, uneven axle weight distribution, and improper securing of cargo (as well as any resulting regulatory fines, road penalties, or accidents).
Business Losses: The Service Provider is not liable for any damages arising from incorrectly calculated quotes, goods left behind due to lack of space, delays, or any loss of profit or business interruption.
"As-Is" Basis: The software is provided on an "as-is" and "as-available" basis, without any express or implied warranties (e.g., merchantability, fitness for a particular purpose).

If the governing laws do not allow the complete exclusion of liability, the maximum extent of the Service Provider's liability for damages shall in no event exceed the amount spent by the User on purchasing credits in the 12 months preceding the incident.

3. Intellectual Property and License

The complete source code of Snapinify Cargo Optimizer, the 3D packing and optimization algorithm, the user interface design, and the internal logical structure are the exclusive intellectual property of the Service Provider (or its licensors). The User is granted a limited, non-exclusive, non-transferable right to use the software for its intended purpose. It is strictly prohibited to reverse engineer, modify, reproduce, or use the software to develop a competing product.

4. System Messages and User Account

By registering, the User acknowledges that they will receive transactional/system messages (e.g., password resets, registration confirmations, credit balance notifications, billing information) from the Service Provider, which are essential for the provision of the service. The User is responsible for maintaining the security of their account, keeping their password confidential, and all activities that occur under their account.

5. Governing Law and Jurisdiction

This agreement, its interpretation, and the use of the service shall be governed by the laws of the United Kingdom, specifically the Laws of England and Wales. In the event of any dispute arising out of or in connection with this agreement, the parties submit to the exclusive jurisdiction of the courts of England and Wales.
